Terms and Conditions

1. Prices

Our prices are quoted in United States Dollars and are subject to change without notice. All federal and Vermont taxes apply unless the purchaser provides proof of exemption from taxation.

2. Minimum Orders

There is no minimum order requirements.

3. Warranties

Every product you buy from us is backed by the seed manufacturer’s warranty. In our discretion and within thirty (30) days of the order’s date, we will replace any defective seeds with new seeds. After thirty (30) days from the order’s date, we will use our best efforts to assist you in obtaining relief from the manufacturer of seeds sold by us to you in accordance with the manufacture’s warranty policy. The forgoing notwithstanding, WE DO WARRANT THAT THE SEEDS SOLD WILL BE MERCHANTABLE OR FIT FOR ANY PARTICULAR REASON.

4. Taxes

Any taxes assessed as a result of the purchase, use or resale of the goods, including sales taxes, is the purchaser’s responsibility.

5. Payment

We prefer payment by major credit card. Payments may be made by check or money order, but we will not process your order until the money order is deposited, or the check has cleared. Checks should be payable to: “Wildlife Habitat Consultants LLP.” Payment is due within thirty days of the purchase order. We will charge you 1.5% per month for accounts due but not paid after thirty days.

6. Shipment

The cost of shipping seeds to you will be in addition to the price quoted for seeds. We will ship seeds to you at your risk and expense.

7. Receiving and Acceptance

Seed is perishable. All shipments of seeds from us to you should be immediately and carefully unpacked and inspected by you on receipt and then placed in proper storage as specified in the seeds package. Any problems with the condition the of seeds should be brought to our attention immediately.

8. Claims

Claims must be made in writing within fifteen (15) days of the shipment date. If you have to makes a claim within fifty (50) days, you agree that you have accepted the seeds received by you unconditionally.

9. Cancellation/Returns/Exchanges

Orders that have been opened are not returnable. Unopened orders may be canceled and returned to us, but must be delivered to us by mail, package or other shipment received within fifteen (15) days of order. After fifteen days, cancellations may be made only by written request to us and our express, written consent, confirming your cancellation or return. Seeds returned for exchange must be unused and in the original packaging.

10. Typographical Errors

In the event we list the price of seeds incorrectly due to typographical error or an error in the pricing or product information received from our suppliers, we have the right to refuse to fill or cancel any orders placed for seeds listed at the incorrect price, including in circumstances where the order has been confirmed or you credit card charged. If your credit card has been charged, we will immediately issue a credit to your credit card account in the amount of the charge.

11. Circumstances beyond our control

We will not be liable for damages to you resulting from an act of God or other circumstance beyond our reasonable control that prevent us from providing seeds to you provided that in the event of such circumstances, we will take all reasonable actions, necessary to enable us to deliver and sell to you the seeds that you have ordered.

12. Exports

We will not sell seeds outside the United States of America. The foregoing notwithstanding, we will ship to purchasers outside the United States of America, provided that the purchaser shall obtain authority, including permits, required for such export and import to the nation of import, and the purchaser will have full responsibility for clearing seeds through the purchasing country’s customs and agricultural quarantine or inspection service.
